Terms of Service — StreamingPro TV

⚠️ StreamingPro TV is a video player. We do not offer channels, subscriptions, content or any IPTV/streaming service. The app ships with no playlist: it plays the IPTV playlist loaded by the user with the details provided by their own service provider.
1. Acceptance
These terms are a binding agreement between you and BMC Technologies SRL (RUC 20602158811, Chiclayo, Peru) ("we") regarding your use of the StreamingPro TV application for Samsung (Tizen) and LG (webOS) televisions (the "App"). By installing or using the App you confirm that you have read, understood and accepted these terms. IF YOU DO NOT AGREE, DO NOT USE THE APP.
2. Service description
The App is a media player designed for smart TVs. It allows end users of an Xtream Codes panel or a similar service to watch their content through its API, playing live TV, movies and series. The App does not provide, host, sell or suggest playlists, channels, movies or series, does not supply credentials of any kind and does not operate any content service.
3. User requirements and responsibility for content
- The user must own a playlist or account supplied by their service provider.
- The user represents and warrants that they hold lawful authorisation to access and view the content reached through their playlist, and that their use complies with the laws of their country and with their provider's terms.
- The user is solely responsible for the legality of the playlist they load and of the content they watch, and for keeping their credentials confidential.
- The App is intended for users aged 18 or over. Minors must use it under supervision; the TV's parental controls allow content restriction.
4. No accounts, no purchases
The App creates no user accounts on our servers, offers no subscriptions, performs no charges and includes no in-app purchases or advertising. The playlist details the user types are stored only on their television.
5. Intellectual property
We own the intellectual property rights in the App: source code, design, text, graphics and marks. The user is granted a revocable, non-exclusive, personal, non-transferable, limited licence to install and use the App on televisions they own or control, under these terms. Copying, modifying, decompiling, redistributing, sublicensing, selling or renting the App, or circumventing its technical or security measures, is prohibited. Third-party products and marks mentioned are the property of their respective owners.
6. Prohibited activities
- Using the App to access content without authorisation or for any unlawful purpose.
- Loading playlists or content the user has no rights to.
- Rebranding, reselling, redistributing or repackaging the App without written authorisation.
- Interfering with the App's operation or with third-party services.
- Using the App in jurisdictions where such use is contrary to applicable law or regulation.
7. Third-party content
The App has no control over the playlists, channels or content the user loads, nor over their provider's practices. Access to any third-party service is governed by that third party's terms and policies. We are not responsible for the content of those playlists or for third-party services.
8. Privacy
Data processing is governed by our Privacy Policy, which forms part of these terms: https://bmctech.pe/privacidad-streamingpro-tv/. The App collects no name, email, phone, contacts or location; playlist details exist only on the user's TV.
9. Infringement notices and takedown
The App hosts and distributes no content, so there is no material of ours to take down. If you are a rights holder and believe a playlist or content reachable through the App infringes your rights, write to info@bmctech.pe (see our DMCA Notice). We will handle any formal request from a competent authority and, where appropriate, disable the functionality or the store listing of the App.
10. Disclaimer of warranties
The App is provided "AS IS" and "AS AVAILABLE". We do not warrant that it will be uninterrupted or error-free, nor the availability, quality, legality or content of third-party playlists or services. To the maximum extent permitted by law we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement. The user assumes all risks arising from use of the App and of any third-party service.
11. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential or punitive damages, nor for data loss, lost profits, service interruption or damages arising from the content, playlist or third-party service used by the user, even if advised of the possibility of such damages. Our total liability for any cause, regardless of the form of action, is limited to the amount actually paid by the user for the App (which is free), i.e. zero.
12. Indemnification
The user shall indemnify BMC Technologies SRL and its officers, employees and agents against any claim, damage, loss or expense (including reasonable legal fees) arising from their use of the App, the playlists or credentials they load, the content they watch, or their breach of these terms.
13. Changes, suspension and termination
We may modify these terms by posting the updated version at this same address with the date on top; changes take effect on posting and continued use means acceptance. We may suspend, withdraw or stop distributing the App at any time, without notice and without liability.
14. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Peru. Any dispute shall be submitted to the competent courts of Chiclayo, Peru.
15. Miscellaneous
If any provision is held invalid, the remaining provisions stay in force. Failure to exercise a right is not a waiver. These terms, together with the Privacy Policy, are the entire agreement between the parties regarding the App.
